Managing claims effectively in physical commodity transactions
Introduction
Physical commodity transactions involve multiple parties, contracts, documents and operational steps. When something goes wrong, identifying a breach is only the beginning. Successfully pursuing or defending a claim requires timely action, appropriate evidence, compliance with contractual procedures and a clear understanding of legal rights, commercial objectives and the chance of obtaining a recovery.
This practical course focuses on the management of commodity claims from the first indication of a problem through negotiation, settlement or formal dispute resolution to obtaining a recovery or successfully defending a claim.
Rather than revisiting general principles of contract law, the course examines what traders and other professionals should do when faced with a potential claim.
Target audience
Commodity traders, trade operations and execution professionals, contract managers, claims professionals, shipping and logistics teams, trade finance professionals, in-house legal professionals and other professionals involved in physical commodity transactions.

Lecturer
George Kaye, Senior Associate, HFW
George is a Senior Associate and English Solicitor in HFW’s Shipping team. His expertise is focused on commercial shipping, yachting, international trade and marine insurance. He is based in our Monaco office, having relocated in 2017.
George specializes in dispute resolution and advisory work. His commercial shipping and yachting experience covers marine casualties, charterparty disputes, cargo claims, newbuild, sale and purchase, refit disputes, and marine insurance issues. George also works for bulk, metal and oil commodity traders.
George acts in international arbitration, both institutional arbitrations such as the LCIA and ad-hoc under the LMAA rules. He regularly attends the High Court in London, primarily the Commercial and Admiralty Courts. He is an active member of Monaco’s maritime community, co-founding YoungShip Monaco and regularly attending the Monaco Propeller Club.

Registrations are accepted on a first-come, first-served basis.
Participants will be awarded a Certificate of Participation.
If a participant is unable to attend the course, a substitute may be appointment at any time. Requests for substitutions will only be accepted by e-mail to info@lcta.ch. For cancellations made 5 days or less before the course start date, 30% of the fee will be retained to cover administrative expenses. All “No Shows” will be charged the full course cost.
Remark for CCTS Alumni: this course is accredited for the SAQ re-certification for the “Certified Commodity Trading Specialist” (CCTS) certification (4 credits).
